Conditions of participation Instagram + Facebook Giveaway
1 Instagram scope/exemption
These terms and conditions apply to all giveaways that we run via the Instagram profile under “bajao_sup” of the BAJAO GmbH.
This promotion is not connected to Instagram and is in no way sponsored, supported or organized by Instagram. All information within the scope of the giveaway is provided exclusively by BAJAO GmbH as the organizer of the giveaway and is the responsible party for data processing within the meaning of the General Data Protection Regulation (DSGVO).
2 Eligible/participation
By participating in the competition, the Instagram user expressly accepts these general conditions of participation.
Both customers and non-customers of the BAJAO GmbH are eligible to participate.
The start of the competition is the respective publication time in our Instagram profile. Participation is only possible until the respective specified draw time. For the corresponding times, please refer to the details of the giveaway on our Instagram profile in the respective giveaway post.
Depending on the competition, participation is possible, for example, by liking a post in our Instagram timeline or commenting on it.
3 Winnings / Prize Determination / Prize Handover
The prize will be specified in the respective sweepstakes posting. Only non-cash prizes will be drawn. A payment of the prize value in money or an exchange of the prize is excluded. The right to win is not transferable.
As a rule, the winner(s) will be determined at random immediately after the end of the competition. In the case of guessing questions, the raffle participants who are closest to the underlying result will win. The winners will be informed via a personal message on Instagram. Each winner must contact the page “bajao_sup” via Instagram message within 5 business days. If a winner does not get in touch within this period, a new winner will be determined.
The delivery of the prizes will be done by parcel shipment.
4 Privacy
All Instagram names of the participants will be collected and stored exclusively for the purpose of determining the prize. All personal data will be deleted no later than 30 days after the end of the competition, but the comments on Instagram will remain and will still be publicly viewable. Participants are entitled to statutory rights of access, modification and revocation. The participant may revoke his/her declared consent to the use of personal data at any time. The revocation must be sent in writing to BAJAO GmbH at the address given in the imprint. After revocation of the consent, the collected and stored personal data of the participant will be deleted immediately. Participation in the competition is then no longer possible.
5 Premature termination of the Giveaway
The organizer reserves the right to change the giveaway due to unforeseen circumstances without prior notice regarding the giveaway components, to cancel or terminate the giveaway. The latter applies in particular if software and/or hardware errors occur and/or other technical and/or legal reasons influence the regular and proper implementation of the competition or make it impossible.
6 Other
Legal recourse is excluded. German law is exclusively applicable. Should any of these provisions be or become invalid, the validity of the remaining terms of use shall not be affected. These Terms of Use may be amended by BAJAO GmbH at any time without separate notification.
